14.01 Felony Deferred Prosecution Program

  1. General Provisions

    The Winnebago County State’s Attorney’s Office has created a Deferred Prosecution Program for first-time, non-violent offenders charged with Class 2 felonies or lower level offenses.

    Defendants admitted to the program shall be ordered to pay fees, fines and costs made payable to the Winnebago County Treasurer’s Office as follows:

    Non-Refundable Application Fee of $50.00

    Program Fee not to exceed $1,000.00

    When applicable, Defendants admitted to the Deferred Prosecution Program shall be
    ordered to pay restitution made payable to the Winnebago County Circuit Clerk:

  2. Deferred Prosecution Program Fund

    That all Deferred Prosecution Application Fees and Program Fees shall be deposited into a dedicated Deferred Prosecution Program Fund maintained by the Winnebago County Treasurer’s Office. The Deferred Prosecution Program Fund is specifically designated for use by the Winnebago County State’s Attorney’s Office for purposes of administering the Deferred Prosecution Program.

  3. Restitution

    It is further ordered that the Winnebago County Circuit Clerk shall receive all restitution payments and issue disbursements consistent with an order prepared by the Winnebago County State’s Attorney’s Office.
